- Reviewing and Drafting Contracts
When parties enter into a legal contract, they often have the best intentions that all matters between them will be handled in an amicable manner. Unfortunately, that is not always the case. Sometimes disputes erupt and parties find it impossible to resolve their differences.
Contracts can be complex and have terms that may require that certain disputes be resolved via mediation or arbitration. Likewise, they may contain restrictions on where and when a lawsuit can be brought to enforce certain legal rights in the contract. All of these issues and others (including provisions regarding the award of attorneys fees for prevailing in a dispute), often require a careful legal analysis to determine the best strategy to forge a resolution to the dispute.
If you have a contract dispute, contact The Law Offices of Donald M. Kreke for help. We will be happy to meet with you to review and analyze the contract and actions of the parties, so that we can determine the best way to resolve the matter.
How The Law Offices of Donald M. Kreke can Help You with Your Contract Disputes
We will meet with you to discuss the underlying facts related to the contract, including the relationship between the contracting parties. To determine the best course of action, we will fully evaluate your existing status and your goals. In doing so, we will typically need to:
- Review the contract at issue, including any attachments and/or addendums, etc.
- Review any documents that are associated with the contract or bargaining and negotiations between the parties, including letters, emails, text messages, proposals, etc.
- Evaluate the oral representations made between the parties.
- Evaluate the acts of the parties, including acts that could be construed as deviating from the responsibilities in the contract, and acts of default, etc.
We may also need to take statements or interview witnesses or third parties, consult with experts or consultants. Each matter is different with a different set of facts and circumstances and that is why we prefer to meet in person with any clients who need our help in reviewing and drafting contracts.
If we determine that the other party is in default, we will seek damages on your behalf. This is typically done via a demand to the other party. If there is no compliance with our demand, we may need to institute a lawsuit on your behalf, unless the contract validly calls for a different form of dispute resolution.
