COLLECTION MATTERS

When people or businesses provide goods or services to others, they expect to get paid.  Unfortunately, that does not always happen and invoices remain unpaid.  This can cause stress and anxiety for any individual or business owner as such funds are not able to be used for beneficial purposes such as paying debts, investing, earning interest, purchasing products or services, etc.

If you have provided goods or services to a person or a business and you have not been paid, call The Law Offices of Donald M. Kreke today.  We can help you collect on unpaid invoices, etc.

Things to Do After an Individual or Business Fails to Pay You for Goods or Services You Provide to Others | A Debt Collection Attorney Guide

Here are some things you should keep in mind after your invoices for goods or services go unpaid.

Our Debt Collection Attorney Guide To The Collections Process

  • Confirm that the debt has not been paid.
  • Compile and record the names, addresses, and contact information of each person who owes you money (debtors).
  • Compile and preserve all documents (including all invoices) associated with the goods or services you provided to the debtor.  This should also include proof that the invoice was sent to the debtor.
  • Determine the total amount that is owed to you by the debtor.
  • Determine when the goods or services were provided to the debtor, when the invoice was sent to the debtor, and when the funds were to be paid by the debtor.
  • Do not do anything that could be construed as harassing the debtor.  There are strict rules (including the Florida Consumer Collection Practices Act) that apply to creditors regarding collection matters and you do not want to violate those rules and be subject to fines.
  • Do not sign a release related to the debt without consulting your attorney.
  • If the debtor calls you and wants to negotiate for less than the amount of the debt, refer him or her to your attorney

How our Debt Collection Attorney Can Help You Collect Unpaid Debts

Once you retain us to serve as your attorneys for your collection matters, we will seek to recover the amount owed to you (plus interest, and attorney’s fees, if possible).

In doing so, we will fully review your unpaid debts and attempt to collect from the debtor by sending him, her, or it a demand letter, requesting full payment of the debt.  If the debtor does not comply, we may be forced to file a lawsuit against the debtor and pursue them via litigation.  If we are successful in the litigation, we will record the judgment and then seek an execution from the court for the total amount due from the debtor.  We will then work with the appropriate sheriff’s office to levy on the debtor’s assets.
